SENATE BILL 214

AN ACT relative to transportation projects.


AMENDED ANALYSIS

This bill requires the department of transportation to consider its type II noise abatement policy. The bill also permits the commissioner of transportation to acquire private or public property to mitigate the effects of transportation projects on environmental and historical resources.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nineteen

AN ACT relative to transportation projects.

Be it Enacted by the Senate and House of Representatives in General Court convened:

275:1 Department of Transportation. The department shall, in accordance with its noise abatement policy, consider its type II noise abatement program, including projects eligible and related costs, as part of the state 10-year transportation improvement plan process, provided revenue becomes available for the program.

275:2 Layout of State Highways; Acquisition of Property; Historical Effects. Amend RSA 230:13, II(b) to read as follows:

(b) Construct, improve, and maintain transportation projects as directed by law and provide mitigation for existing or potential [environmental] effects of transportation projects on environmental and historical resources.

275:3 Effective Date. This act shall take effect 60 days after its passage.
