AN ACT requiring disclosure by motor vehicle manufacturers of proprietary repair information.


ANALYSIS

This bill requires a motor vehicle manufacturer to disclose that the manufacturer maintains proprietary repair information for the vehicle to the dealer and purchaser and to include that fact on the vehicle data sheet or window sticker.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty

AN ACT requiring disclosure by motor vehicle manufacturers of proprietary repair information.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Regulation of Business Practices Between Motor Vehicle Manufacturers, Distributors and Dealers; Disclosure of Proprietary Repair Information. Amend RSA 357-C by inserting after section 5 the following new section:

357-C:5-a Disclosure of Proprietary Repair Information. If a motor vehicle manufacturer maintains proprietary repair information for a vehicle, the manufacturer shall disclose that fact, in writing, to the dealer and to the ultimate purchaser of the vehicle prior to delivery. The fact that the manufacturer maintains proprietary repair information for the vehicle shall be clearly stated on the vehicle data sheet, or "window sticker" attached to the vehicle.

2 Effective Date. This act shall take effect January 1, 2021.
