STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT prohibiting state agencies from spraying pesticides targeting mosquitoes before dusk.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Public Health; Mosquito Control Policy for State Agencies. Amend RSA 142-A:3, VII to read as follows:
VII.(a) State agencies managing land shall allow the use of pesticides to control adult mosquitoes, in accordance with applicable law and rules, in areas where a public health threat has been declared by the commissioner pursuant to RSA 141-C and the land:
[(a)] (1) Is adjacent to areas of high public use;
[(b)] (2) Has areas where topographical and other conditions result in high adult mosquito populations;
[(c)] (3) Is located within a focal area determined by the department to have a risk of a human outbreak of arboviral disease which warrants the use of pesticides to control adult mosquitoes as set forth in the arboviral illness response plan adopted by the department; and
[(d)] (4) Is managed in accordance with general integrated pest management practices.
(b) No state agency managing land shall allow the use of pesticides to control mosquitoes before dusk.
2 Effective Date. This act shall take effect 60 days after its passage.
