STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty

AN ACT relative to attorneys fees in child support cases.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Parental Rights and Responsibilities; Child Support; Disclosure of Attorneys Fees. Amend RSA 461-A:14 by inserting after paragraph XVIII the following new paragraph:

XIX. In any proceeding to enforce the payment of child support, if the child support obligor is represented by counsel, the court shall require, on its own motion or at the request of the obligee, that the obligor submit a financial affidavit regarding the amount paid in attorneys fees and the source of funds for the attorney. Payment of child support shall have priority over the payment of attorneys fees and all other costs assessed by the court or associated with the proceeding, such as fees for guardians ad litem and visitation centers.

2 Effective Date. This act shall take effect 60 days after its passage.
