AN ACT prohibiting the posting of certain state properties as no trespassing areas.


ANALYSIS

This bill prohibits state agencies from posting state property as a no trespassing or no hunting area unless the property is used for equipment storage or a safety issue exists. The executive director of fish and game would be responsible for safety determinations.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty

AN ACT prohibiting the posting of certain state properties as no trespassing areas.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Fish and Game Commission; Access to State Lands. Amend RSA 206 by inserting after section 16 the following new section:

206:16-a Access to State Lands; Posting of No Trespassing and No Hunting Areas Prohibited. No state agency shall post as a no trespassing or no hunting area any state property, unless the property is used for equipment storage or access is restricted for safety reasons. Posting of an equipment storage area shall be limited to the storage area only. Safety determinations shall be made by the executive director, following an investigation of the site.

2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill prohibits state agencies from posting state property as a no trespassing or no hunting area unless the property is used for equipment storage or a safety issue exists. The Executive Director of Fish and Game would be responsible for safety determinations.

The Fish and Game Department indicates it does not have complete information on all property owned by the State. Without such information, the Department cannot estimate the number of staff required to enforce the provisions of the bill including assessment of sites to identify safety issues. However, the Department states, if the a safety evaluation is only required when a state agency seeks to post a specific site, the cost to the Department would be much lower.

The Department of Administrative Services indicates this bill would have no fiscal impact as it would not require the Department to perform any additional duties or purchase any additional equipment or supplies.

It is assumed this bill will not take effect until FY 2021.
