STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty

AN ACT relative to organ transplants.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Organ Transplantation Sourced From Foreign Locations. Amend RSA 126-A by inserting after section 18-b the following new section:

126-A:18-c Organ Transplantation Sourced From Foreign Locations. No state or federal funds for Medicaid shall be used for organ transplantation if the organs are received or sourced from outside of the United States.

2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill prohibits state and/or federal Medicaid funds from being used for organ transplants if the organs are received or sourced from outside of the United States. The Department of Health and Human Services reports that, based on information supplied by New England Donor Services, Canada is the only country from which an organ could be donated within an appropriate time period for medical transplant use in New Hampshire, and it would be rare for an organ donated by an individual in Canada to not have a recipient in Canada and instead be offered to someone in the United States. Based on this, it is unlikely that the bill will have an impact on state Medicaid expenditures. To the extent that the bill does result in a cost savings due to a transplant not taking place, the Department assumes the savings will be offset by the cost of treatment for continued disease progression.

It is assumed any fiscal impact will not occur until FY 2021.
