STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT relative to certain additional part-time employment of retirees in the retirement system.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Retirement System; Part-time Employment; Exceptions. Amend RSA 100-A:1, XXXIV to read as follows:
XXXIV. "Part-time" for purposes of employment of a retired member of the New Hampshire retirement system but excepting per diem court security officers and court bailiffs, means employment by one or more participating employers of the retired member which shall not exceed 1,352 hours in a calendar year, except as provided in RSA 100-A:7-b. Notwithstanding the foregoing, unless excepted under RSA 100-A:7-b, no retired member shall be employed on a part-time basis by any participating employer for a period of 28 days from the member's effective date of retirement.
2 Exception Added; Community College System. Amend RSA 100-A:7-b to read as follows:
100-A:7-b Certain Part-Time Employment; [Emergency Exception] Exceptions.
I. The annual limitations on part-time employment as defined in RSA 100-A:1, XXXIV shall be modified for retired members to exclude any hours worked during an emergency under this section. For purposes of this section, an emergency includes any event declared by the governor or while working under the direction of the director of the division of forests and lands during woodland fire control. Employers shall include hours worked during an emergency as a separate entry in the report required in RSA 100-A:16, VII(a).
II. A member who retires from active service with an employer, but who at the time of application for retirement was concurrently employed by a different employer in a part-time position, shall not be required to comply with the 28-day requirement in RSA 100-A:1, XXXIV for such part-time employment, provided the other requirements of this chapter are met.
3 Effective Date. This act shall take effect 60 days after its passage.

*The New Hampshire Retirement System states it is not able to separate the fiscal impact of this legislation between county and local government, therefore the fiscal impact is shown together as political subdivisions.
METHODOLOGY:
This bill amends the provision governing part-time employment limits for retired members of the New Hampshire Retirement System. Currently, a member who retires from a participating employer may not be employed by a participating employer on a part-time basis for a period of 28 days from the member's effective date of retirement. This limit is currently not applicable to per diem court security officers, court bailiffs or part-time employment for work during an emergency. The bill would also exempt from the 28 day limit those members who retire from active service with an employer but who at the time of application for retirement are concurrently employed by a different participating employer on a part-time basis. The New Hampshire Retirement System (NHRS) is unable to forecast what fiscal impact this provision may have on the System. NHRS also notes there is no penalty in either current law or this bill for a retiree working part-time during the 28 day period.
