STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nineteen
AN ACT relative to recounts in elections.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Elections; Ballot Law Commission; Jurisdiction; Advisory Opinions. Amend RSA 665 by inserting after section 8 the following new section:
665:8-a Advisory Opinions.
I. The ballot law commission shall, in response to an appeal by any candidate who was not declared the winner of an election, have the authority to issue an advisory opinion relative to the election and qualifications of a successful candidate after any election. Such opinion shall be subject to the appropriate body's final decision on the election and qualification of its members.
II. Requests for advisory opinions under this section shall be submitted to the ballot law commission within 3 days of an election or recount, as applicable.
2 Effective Date. This act shall take effect 60 days after its passage.
