STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nineteen
AN ACT relative to emergency generators in certain senior housing.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Senior Housing; Emergency Power Generator. Amend RSA 161-M by inserting after section 4 the following new section:
161-M:4-a Emergency Power Generator. Any facility as defined in RSA 161-M:2 which receives any state, county, or federal funding for services to its residents shall install and maintain at least one emergency power generator capable of providing a minimum of 48 hours of sufficient electrical power to a designated and accessible common area in the facility for use in heating, cooling, water, lighting, communications, mobility equipment, and medical equipment.
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill requires that senior housing receiving public funding be equipped with emergency power generator service in a common area. The Department of Health and Human Services states the bill will have no impact on Department revenue or expenditures.
Because of its location in RSA 161, which references penalties found in RSA 358-A:6, this bill contains penalties that may have an impact on the New Hampshire judicial and correctional systems. There is no method to determine how many charges would be brought as a result of the changes contained in this bill to determine the fiscal impact on expenditures. However, the entities impacted have provided the potential costs associated with these penalties below.
