STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
AN ACT establishing a school facility planning and development program in the department of education.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; School Facility Planning and Development Program. Amend RSA 198 by inserting after section 15-z the following new subdivision:
School Facility Planning and Development Program
198:15-aa School Facility Planning and Development Program
I. There is established a school facility planning and development program in the department of education, bureau of school safety and facility management. The bureau shall establish within the department a revolving fund called the school facility planning and development fund to be used for the following purposes:
(a) To help school districts and chartered public schools with planning and development expenses related to facility improvement projects, including but not limited to projects eligible for school building aid under this chapter.
(b) To administer a loan program. Local school districts and chartered public schools may apply for facility planning and development loans for supporting long-term school facility plans including acquisition, construction, renovation and related activities.
(1) Eligible planning costs include but are not limited to fees for architects, engineers, attorney, and other real estate, finance, and construction professionals.
(2) The loan should cover costs which are not eligible for funding via existing state and federal programs.
(3) Loans shall be are available for up to $100,000 and shall be repaid on an interest-free basis, and on a schedule determined by the department.
(4) The department shall adopt in rules under RSA 541-A criteria for prioritizing applicants and may prioritize applicants able to provide matching funds.
II. The fund shall be nonlapsing and continually appropriated to the department of education, to be expended by the bureau of school safety and facility management. Repayments of loans received by the bureau of school safety and facility management shall be deposited into this fund, along with any available state or federal appropriations made for the purpose of the program.
2 New Subparagraph; Treasury; Application of Receipts. Amend RSA 6:12, I(b) by inserting after subparagraph (382) the following new subparagraph:
(383) Moneys in the school facility planning and development fund established in RSA 198:15-aa.
3 Effective Date. This act shall take effect July 1, 2022.

METHODOLOGY:
This bill establishes a school facility planning and development program in the Department of Education, Bureau of School Safety and Facility Management, and a revolving loan fund for local school districts and chartered public schools to assist with certain facility improvement projects (up to $100,000 interest-free). The Department assumes the primary role of staff would be to administer and manage the loan program, and not to provide technical assistance regarding aiding the districts with the actual planning and development of their facility improvement projects. The Department anticipates hiring a part-time program specialist position (labor grade 23) at an estimated cost of approximately $40,000 per year, beginning in FY 2023, assuming a start date of July 1, 2022, to administer the loan program. As far as the loan program itself, since this bill provides no initial appropriation or transfer from another funding sources into the newly established revolving fund, any loan program activity (resulting in revolving fund and local school district revenue or expenditure), assumed to be net-zero, would be contingent upon future funding methods, if any.
