AN ACT enabling municipalities to incorporate sewage disposal systems as part of their stormwater utility.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty Two

AN ACT enabling municipalities to incorporate sewage disposal systems as part of their stormwater utility.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Powers and Duties of Towns; Water and/or Sewer Utility Districts; Definitions. Amend RSA 31:135 to read as follows:

31:135 Definition. In this subdivision, "water and/or sewer utility" means an entity established for the acquisition, operation, and management of sewage disposal systems, as defined in 485-A:2, and other water and sewer infrastructure.

2 New Paragraphs; Criteria for Stormwater Utilities. Amend RSA 149-I:6-c by inserting after paragraph VI the following new paragraphs:

VII. Municipalities may incorporate sewage disposal systems, as defined in 485-A:2, as part of their stormwater utility, if not already included in their sewer utility.

VIII. All plans or proposals submitted by a stormwater utility to the legislative body of a municipality for approval shall include at least one estimate of the costs of the plan prepared by a professional entity engaged in stormwater mitigation or sewage treatment and disposal.

3 Effective Date. This act shall take effect 60 days after its passage.
