AN ACT relative to school board member qualifications.

This bill limits eligibility for school board membership by excluding persons who are members of municipal governing bodies or whose immediate family members are employed in the school district or school administrative unit.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty Three

AN ACT relative to school board member qualifications.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 School District Elections; School Board Candidates. Amend RSA 671:18 to read as follows:

671:18 Qualifications. To become a candidate for any school district office, a person must be a registered voter in the district. No person holding the office of member of the school board shall at the same time hold the office of district moderator, treasurer, or auditor, or be a member of the municipal governing body, or an at-large member of the municipal budget committee. No person, if they or a member of their immediate family, is employed on a salaried basis by a school administrative unit or by any school district within a school administrative unit shall be a school board member in any district of the same school administrative unit as that which they or a member of their immediate family are employed. Salaried positions shall include, but are not limited to, the following: teacher, paraprofessional, custodian, administrator, secretary, school bus driver (if paid by the district), school lunch worker and teacher's aide. For the purposes of this section, immediate family members shall include: spouse, domestic partner, child, parent, brother or sister, as well as step-child, step-parent, and step-siblings.

2 Effective Date. This act shall take effect 60 days after its passage.
