STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty Three

AN ACT to create a public county registry of the monthly rent charged by landlords for each owned unit.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Registry of Rents. Amend RSA 478 by inserting after section 17-j the following new section:

478:17-k Registry of Rents. The register of deeds shall create a registry that lists the monthly rent charged for properties leased within the county. Landlords who own property within the county shall submit a list annually by December 31 recording the monthly rent charged at each property within the county. If the landlord changes the rent, they shall have 30 days to notify the register of the change in rent. Such registry shall be made available to the public.

2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill would require the register of deeds in each county to create a public registry for all rents charged for properties within the county. The New Hampshire Association of Counties (NHAC) states currently there is not a list of how many rental properties/owners are in each county. To administer this bill the register of deeds office would need to do substantial research, acquire software and/or a computer systems and staffing to keep up with the changes. The NHAC states they are unable to calculate a cost but there will be an indeterminable increase in County expenditures.

It is assumed any fiscal impact would not occur until FY 2024.
