STATE OF NEW HAMPSHIRE

AN ACT making an appropriation to PFAS remediation fund grants.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Department of Environmental Services; Appropriation; PFAS Remediation Loan Fund. The sums of $5,000,000 for the fiscal year ending June 30, 2023 and $5,000,000 for the fiscal year ending June 30, 2024 are hereby appropriated to the PFAS remediation loan fund established under RSA 485-H:10 to fund grants and reimbursements in accordance with RSA 485-H:11. The governor is authorized to draw a warrant for said sums out of any money in the treasury not otherwise appropriated.

2 Effective Date. This act shall take effect July 1, 2023.

METHODOLOGY:

This bill makes an appropriation to the Department of Environmental Services to fund PFAS fund grants. The Department of Environmental Services indicates this bill would increase the amount of grant funding available under the Per- and Polyfluorinated Alkyl Substances (PFAS) Remediation Grant and Loan Fund (PFAS RLF) established under RAS 485-H. The purpose of the program is to administer grants and reimbursements to entities that meet the eligibility criteria for PFAS drinking water remediation. The appropriation would allow for the continuation of the PFAS RLF work, and the impact to current operations would be limited to the additional work required to administer these funds, consistent with existing practices. The Department assumes it would conduct the authorized activities using existing staff.

The Department assumes that it will award a substantial amount of this appropriation to municipal and county governments, to address needed drinking water remediation. Municipal governments would likely receive the majority of the funds, with county governments potentially receiving a small portion. The Department assumes the demand for the funds would be complete and prompt. Once the grants are awarded, the Department anticipates the funds would be expended in FY 2024, FY 2025, and FY 2026.
