AN ACT relative to permitting requirements before timber harvesting operations in a wetland.


ANALYSIS

This bill requires that persons or entities conducting timber harvesting operations in wetlands verify compliance with and maintain in their records all permitting documents required for the work being done.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty Four

AN ACT relative to permitting requirements before timber harvesting operations in a wetland.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Timber Harvesting; Operations in Wetlands. Amend RSA 227-J:6 by inserting after paragraph III the following new paragraph:

IV.(a) Prior to any person or entity commencing timber harvesting operations in wetlands as described in paragraphs I or II, including an agent of or contractor for the landowner, the person or entity shall verify compliance with all permitting documents required by state law, as well as any permits or records required by municipal ordinances.

(b) The person or entity conducting timber harvesting operations in wetlands as described in paragraphs I or II shall also maintain records of, and make available to state and local enforcement officials, copies of all permitting documents required by state law, as well as any permits or records required by municipal ordinances, at all times while conducting tree harvesting work.

(c) Failure to comply with the requirements of subparagraphs (a) and (b) may result in penalties under RSA 482-A.

2 Effective Date. This act shall take effect 60 days after its passage.
