AN ACT relative to the sale of human blood and organs.


ANALYSIS

This bill provides that the state of New Hampshire shall not prohibit, restrict, or regulate the private sale, purchase, use, possession, or donation of human blood or organs in the state.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty Four

AN ACT relative to the sale of human blood and organs.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Sale of Blood and Organs. Amend RSA by inserting after chapter 359-U the following new chapter:

CHAPTER 359-V

SALE OF BLOOD AND ORGANS

359-V:1 Sale of Blood, Blood Products and Organs Permitted. The state of New Hampshire shall not prohibit, restrict, or otherwise regulate the private sale, purchase, use, possession, or donation of human blood, blood products, or organs in the state. In this section, "blood and blood products" means whole human blood, plasma, or serum or any product derived from human blood, plasma, or serum.

2 Health Facility; Rulemaking. Amend RSA 151:2, I(c) to read as follows:

(c) Laboratories performing tests or analyses of human samples, collection stations, or laboratories performing testing on therapeutic cannabis pursuant to RSA 126-X:6, III(a)(16); provided that no license shall be required for, and no rule shall apply to, the private sale, purchase, use, possession, or donation of organs or blood and blood products, as defined in RSA 359-V:1.

3 Effective Date. This act shall take effect 60 days after its passage.
