ANALYSIS

This bill adds a checkbox to the division of motor vehicles driver's license and nondriver's identification card application form. The checkbox, when marked, indicates a person has registered with the division of motor vehicles as an organ donor and that they want their organ donation to go to a New Hampshire resident-recipient before an out-of-state resident.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty Three

AN ACT relative to a New Hampshire first designation on the donor registry for anatomical gifts.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Donor Registry for Anatomical Gifts. Amend RSA 263:41 by inserting after paragraph II the following new paragraph:

II-a. The director shall add a “New Hampshire First” checkbox to the New Hampshire driver's license and nondriver's picture identification card application form. The checkbox, when checked or marked, shall indicate a person that has registered with the division of motor vehicles as an organ and tissue donor under the provisions of this section and intends that their organs be donated to suitable New Hampshire resident-recipients on the organ transplant waiting list first before out-of-state residents.

2 Effective Date. This act shall take effect 60 days after its passage.

The Legislative Budget Assistant has determined that this legislation, as introduced, has a total fiscal impact of less than $10,000 in each of the fiscal years 2023 through 2026.
