STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty Three

AN ACT relative to electric utility smart meter gateway devices.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Property Owner's Consent Required for Smart Meter Gateway Devices. Amend RSA 374:62 by inserting after paragraph II the following new paragraph:

II-a. Electric utilities shall provide customers with the option to purchase a smart meter gateway device, to be installed, removed, or changed by authorized utility personnel or approved contractors, and electric utilities shall notify customers of this option.

2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill requires electric utilities to provide customers with the option to purchase smart meter

gateway devices.

The Department of Energy indicates any expenditures by a state, county or local government would be for the purchase and installation of a smart meter. With a smart meter, a customer could possibly determine if electric usage could be modified to lower electric bills, especially if the customer is on a time of use rate where usage could be shifted to lower rate periods. The Department states the fiscal impact is indeterminable because it is unknown what customers would opt to install a smart meter and for those that do, what impact it would have on the customer’s electric bill.

The Public Utilities Commission indicated this bill would have no direct fiscal impact on state, county or local expenditures.

It is assumed that any fiscal impact would occur after FY 2023.
