AN ACT relative to residency requirements for deputy town clerks.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty Three

AN ACT relative to residency requirements for deputy town clerks.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Town Officers; Deputy Town Clerk. Amend RSA 41:18 to read as follows:

41:18 Deputy Town Clerk. Each town may have a deputy town clerk who shall be qualified in the same manner as the town clerk, and who shall perform all the duties of the town clerk in case of his or her absence by sickness, resignation, or otherwise [subject to the provisions of RSA 669:65]. A deputy town clerk appointed hereunder shall be appointed by the [elected] town clerk with the approval of the selectmen.

2 Town Clerk; Reference to Deputy Clerk Residency. Amend RSA 669:65 to read as follows:

669:65 Town Clerk. Vacancies in the office of town clerk shall be filled by appointment made by the selectmen, except in towns in which pursuant to RSA 41:18 the selectmen have previously [appointed] approved an appointment of a deputy town clerk, in which case the deputy shall serve as town clerk until the next annual town election[, unless the deputy does not have his or her domicile in the town, in which case the vacancy shall be filled by appointment made by the selectmen].

3 Effective Date. This act shall take effect January 1, 2024.
