STATE OF NEW HAMPSHIRE

AN ACT relative to the definition of salon.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Occupations and Professions; Barbering, Cosmetology, and Esthetics; Definitions. Amend RSA 313-A:1, XII to read as follows:

XII. "Salon" means a beauty salon or other place kept open for the business of cosmetology, manicuring, or esthetics; however, for the purposes of this chapter, a salon shall not include the provision of cosmetology and barbering services in a client's residence, temporary or otherwise.

2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill amends RSA 313-A:1 XII, redefining "salon" to exempt individuals offering cosmetology and barbering services in a client's residence, temporary or otherwise.

The Office of Professional Licensure and Certification (OPLC) states the fiscal impact on State revenues is indeterminable as the OPLC is uncertain how many individuals holding salon shop licenses (currently $100 for a two-year term) might opt not to acquire or renew shop licenses if a "home services" alternative exists. This shift could potentially result in revenue loss. However, any losses might be offset by new licensure applicants offering services outside of a traditional shop setting. The Office lacks data to accurately estimate these changes presently. Lastly, no additional expenditures are expected due to this redefinition.

It is assumed the fiscal impact will not occur until FY 2025.
