RECOMMENDATION TO ACCEPT RESIGNATION REQUEST

On October 21, 2014, the Professional Conduct Committee deliberated Michael R. Callahan’s request to resign pursuant to Rule 37(11). Members present included David M. Rothstein, Chair, Peter

G. Beeson, Susan R. Chollet, Richard H. Darling, Heather E. Krans, Georges J. Roy, Richard D. Sager. Benette Pizzimenti, Vice Chair, and David W. Ruoff were absent. Alan J. Cronheim and Martha Van Oot were recused, and did not participate in the discussion or vote. Mr. Callahan was admitted to the New Hampshire Bar in 1967 and practiced law since that time. He is 74 years old. He does not intend to continue practicing law. Mr. Callahan executed an affidavit on September 4, 2014, acknowledging that there was clear and convincing evidence that he violated the following Rules of Professional Conduct: Rule 1.1 Competence Rule 1.3 Diligence Rule 1.4 Communications Rule 8.4(a) Violating the Rules of Professional Conduct Mr. Callahan violated the Rules of Professional Conduct in connection with his role as attorney for Lucien Groleau. ’ The parties executed an Assented-to Motion To Permit Waiver of Formal Proceedings and For Final Ruling. Disciplinary Counsel recommends that Mr. Callahan be allowed to resign from the Bar. Mr. Callahan also agreed to pay costs in the investigation and pursuit of this disciplinary matter.
