ORDER LD-2013-0003, In the Matter of Jason A. Czekalski On April 30, 2014, the Attorney Discipline Office filed certified copies of the Superior Court returns in criminal cases involving Attorney Jason A. Czekalski. The returns show that Attorney Czekalski was convicted of three charges of aggravated felonious sexual assault and one charge of felonious sexual assault. Attorney Czekalski’s convictions were upheld by this court on appeal. See 2014-0299, State of New Hampshire v. Jason Czekalski, 169 N.H. (decided April 11, 2017). The court concludes that the crimes of which Attorney Czekalski was convicted constitute “serious crimes” for purposes of Supreme Court Rule 37(9). Rule 37(9)(d) provides that “[u]pon the receipt of a certificate of conviction of an attorney for a ‘serious crime, ’ the court may, and shall if suspension has been ordered pursuant to subsection (a) above, institute a formal disciplinary proceeding by issuing an order to the attorney to show cause why the attorney should not be disbarred as result of the conviction.” In accordance with this provision, on July 21, 2017, the court issued an order requiring Attorney Czekalski to show cause why he should not be disbarred as a result of the conviction. Attorney Czekalski filed a response in which he stated that court should do “whatever it thinks is best with regard to this matter.” In light of the seriousness of Attorney Czekalski’s misconduct, the court concludes that he should be disbarred. THEREFORE, the court orders that Jason A. Czekalski be disbarred from the practice of law in New Hampshire. He is hereby assessed all expenses incurred by the Professional Conduct Committee in the investigation and prosecution of this matter. Dalianis, C.J., and Hicks, Lynn, and Bassett, JJ., concurred.
