ORDER LD-2017-0016, In the Matter of Tamblyn L. Fuller Gosling, Esquire On November 20, 2017, the Attorney Discipline Office (ADO) filed an assented-to petition for immediate interim suspension of Attorney Tamblyn L. Fuller Gosling from the practice of law in New Hampshire. The ADO alleges, and Attorney Fuller Gosling admits, that she: (1) misappropriated client funds from an estate for which she was serving as executor; and (2) committed myriad violations of Rule of Professional Conduct 1.15 and Supreme Court Rule 50, by commingling of personal funds with client funds, paying personal expenses from her trust account, failing to maintain records required for trust accounts, failing to safeguard client property, and filing inaccurate and incomplete trust accounting certificates. The ADO states that Attorney Fuller Gosling assents to the immediate interim suspension and waives the requirement of Rule 37(9-A) that she be provided an opportunity to respond to the petition prior to a ruling by the court. Supreme Court Rule 37(16)(f) provides: The court may suspend attorneys . . . upon such terms and conditions as the court deem necessary for the protection of the public and the preservation of the integrity of the legal profession. Based on the information submitted by the ADO in its petition, the court finds that Attorney Fuller Gosling’s immediate suspension from the practice of law is necessary to protect the public and to preserve the integrity of the legal profession. See Rule 37(16)(d) and (f). Accordingly, it is hereby ordered: (1) In accordance with Rule 37(16)(d) and (f), Attorney Tamblyn L. Fuller Gosling is immediately suspended from the practice of law in New Hampshire pending resolution of the pending disciplinary matter and further order of this court.
(2) Copies of the petition for immediate interim suspension and of this order shall be served on Attorney Fuller Gosling by first class mail and certified mail at the latest address that Attorney Fuller Gosling provided to the New Hampshire Bar Association. (3) Attorney Fuller Gosling is enjoined from transferring, assigning, hypothecating, or in any manner disposing of or conveying any assets of clients, whether real, personal, beneficial or mixed. (4) Attorney Fuller Gosling is ordered to file a pleading in the Estate of Martel matter resigning as the executor of the estate on or before December 11, 2017. The court will appoint an attorney to take immediate possession of the client files and trust and other fiduciary accounts of Attorney Fuller Gosling, to make an inventory of such files and accounts, and to take such action as the attorney deems necessary to protect the interests of Attorney Fuller Gosling’s clients. Upon the appointment of this attorney, Attorney Fuller Gosling is ordered to cooperate with the attorney to notify all clients of her suspension and to close her trust and fiduciary accounts and distribute any funds therein to the proper persons or entities.
