In Case No. LD-2016-0022, In the Matter of Seth Bader, Esquire, the court on April 6, 2017, issued the following order: On March 27, 2017, Attorney Seth Bader submitted an amended affidavit of resignation from the bar. Attorney Bader stated that the affidavit was intended to satisfy the requirements of Supreme Court Rule 37(11), which sets forth the procedure for an attorney under disciplinary investigation to resign from the bar. Having reviewed the amended affidavit, the court concludes that Attorney Bader’s resignation should be accepted in accordance with Rule 37(11). Attorney Bader’s resignation from the bar is hereby accepted. The hearing before the referee scheduled for April 28, 2017 is canceled. RESPONDENT SETH BADER'S AMENDED AFFIDAVIT
OF RESIGNATION FROM THE BAR
(1) I am the respondent in the above-captioned matter. I have been a member of the New Hampshire Bar since 1992. I have been under suspension since 1997, due to felony charges unrelated to my legal practice. I was convicted of two such felonies in
1998. The Attorney Discipline Office has recently sought my disbarment, due solely to my felony convictions. (2) I have no doubt that the ADO can prove that my felony convictions exist. I cannot prove that my felony convictions do not exist, nor have I ever made such a claim. (3) I have come to believe that the ADO can obtain my disbarment due solely to my felony convictions, without having to prove any other fact. I have also come to believe that no fact which I can now prove and get admitted into evidence will prevent the ADO from obtaining my disbarment. (4) I have come to believe that it is to my advantage to resign from the Bar, rather than being disbarred. (5) I therefore seek to resign from the Bar, rather than being disbarred. I have made that decision voluntarily and under no duress. (6) I expect this affidavit to result in my resignation from the Bar.
(7) I intend this amended affidavit to include all of the elements required by New Hampshire Supreme Court Rule 37(11). My prior affidavit was found to be deficient in that regard Zod fab focth 2] 70> eth“Bade Date
