The following summaries of the issues on appeal have been prepared by clerk’s office staff for the convenience of the public. The Supreme Court has neither approved nor reviewed any of the summaries. The parties’ filings and the applicable record — not these summaries — define and establish the issues that the Supreme Court will consider in a case. Please note that, in the interest of brevity, some issues in a listed case may have been combined or not summarized. Whether the State Board of Education erred in finding that the parents met their burden of establishing a manifest educational hardship when the record in this case demonstrates that: (1) only Younger Doe was subjected to a substantiated case of bullying by a single first -grade student with behavioral challenges; (2) this bullying incident was effectively remediated by the school district which included, in part, the imposition of the non-contact contracts; (3) the parents failed to present any evidence in the record of any additional bullying incidents occurring thereafter to either student; and (4) the students’ grades were acceptable and, in some cases, exemplary.
