Whether the trial court erred by granting the defendants’ motion for summary judgment, where the plaintiff, in accordance with RSA 479:13, submitted a request in writing to defendant FCI Lender Services, Inc for a payoff statement for plaintiffs, where FCI Lender Services, Inc., in response to the plaintiff’s request, issued its Demand and Loan Payoff statement, where the plaintiff remitted the full amount set forth in the statement to FCI Lender Services, Inc., which it received and where, within 60 days after receipt of the payoff funds, failed to discharge its mortgage contrary to RSA 479:7(11).
