126-X:10 Annual Data Report; Release of Data. –

I.

The commissioner of the department of health and human services shall report annually on the therapeutic use of cannabis program established under this chapter to the health and human services oversight committee established under RSA 126-A:13, to the board of medicine, and to the board of nursing.

II.

The report shall be in electronic format to allow for identification of patterns of certification by patient and caregiver, location, age, medical condition, symptom, or side effect, and provider, and for analysis and research to inform future policy, educational, and clinical decisions.

III.

The initial report shall be filed no later than December 1, 2014.

IV.

The commissioner's data report shall include but not be limited to the following information:

The number of designated caregivers and the number of qualifying patients, by town or city and county.

(b)

The ages of the qualifying patients and the ages of the designated caregivers.

(c)

The qualifying medical conditions and the number of each qualifying medical condition.

(d)

The symptoms or side effects and the number of each symptom or side effect.

The number of physicians and the number of advanced practice registered nurses issuing written certifications.

The number of providers in each medical specialty issuing written certifications.

Any other issues related to the therapeutic use of cannabis permitted under this chapter that the health and human services oversight committee shall request.

A summary of the report submitted by alternative treatment centers as required under RSA 126-X:8, XII.

VI.

Notwithstanding any other provision of law, data collected under this chapter, including de-identified or aggregate data contained in the confidential registry database, may be released, with the approval of the commissioner or designee, to individuals or entities for the purposes of public health, health care operations, or research if such release is consistent with all applicable HIPAA standards.
