135-C:57 Treatment Rights; Rules. – Persons receiving mental health services shall have the right to:
Copy linkBe informed of and to give consent before administration of any treatment. All elements of an informed decision as defined in RSA 135-C:2, IX shall be present.
Copy linkRefuse all forms of medication, treatment, or services, except emergency treatment under the terms and conditions prescribed by law or by rules adopted by the commissioner under RSA 541-A.
Copy linkTreatment in the least restrictive environment necessary to achieve the purposes of the treatment.
Copy linkFreedom from seclusion or physical or pharmacological restraint. Seclusion or restraint shall be administered only with the consent of the person, who has made an informed decision, or as a form of emergency treatment imposed by law or by rules, adopted by the commissioner under RSA 541-A.
