135-C:61 Rulemaking. – The commissioner shall adopt rules, pursuant to RSA 541-A, relative to: I. A definition of "severely mentally disabled" or "severe mental disability". II. Eligibility criteria and procedures for admission to the state facilities as required by RSA 135-C:4 and 135-C:13. III. Regulating state services as authorized by RSA 135-C:5. IV. Necessary criteria and the process of approval for community mental health programs as required by RSA 135-C:10. V. Client withdrawal procedures in accordance with RSA 135-C:16. VI. The termination or suspension of services by a program or facility in accordance with RSA 135-C:18. VII. Development of individual service plans for clients under RSA 135-C:19. VIII. Criteria and procedures for designating a facility as a receiving facility as required by RSA 135-C:26. IX. Transfers by one receiving facility to another and the procedures for challenging that transfer in accordance with RSA 135-C:48. X. Appeals from revocation of a conditional discharge in accordance with RSA 135-C:52. XI. Treatment and communication rights of persons receiving mental health services as provided in RSA 135-C:57 and 58. XII.
