270:11 Rulemaking and Enforcement. –
Copy linkThe commissioner of safety, consistent with the policy of this chapter, shall adopt rules under RSA 541-A relative to the following:
Copy linkRequired equipment of all boats, including rafts and floats of whatever kind, operated or used on any public waters of the state.
Copy linkThe operation of all boats, including rafts and floats of any kind, operated or used on any public waters of the state.
Copy linkThe classification, examination, and certification of captains, masters, engineers, and pilots of all boats operated or used on any public waters of the state.
Copy linkA recommended uniform fine schedule for any boating violations, which shall be submitted to the supreme court for their use under RSA 502-A:19-b, V.
Copy linkThe commissioner shall enforce the provisions of this chapter and the rules adopted under this section.
Copy linkIn the enforcement of this chapter and the rules adopted under this section, the commissioner and the commissioner's duly authorized representatives shall have the powers of a peace officer in any county of the state.
Copy linkFor the rules under subparagraph I(a), the commissioner may adopt by reference, as amended, the current version of the federal boating safety equipment regulations promulgated by the U.S. Coast Guard, Department of Homeland Security, contained in 33 C.F.R. parts 175.13-175.25, 175.101-175.140, 175.110-175.120, and 175.301-175.320. The commissioner shall be authorized to exempt boats and operators operating exclusively on state waters from such rules which the commissioner determines impose an unnecessary regulatory burden without providing a corresponding safety benefit.
