270:26-b Certain Containers Prohibited as Floats. –
Copy linkNo owner of any float, dock, raft or similar device or structure shall employ for flotation in the public waters of the state any container which formerly contained any hazardous or toxic substance, as defined by RSA 147-B:2, which poses a danger to public health or the environment unless such container has been rendered harmless by internal treatment for the removal of the hazardous or toxic substance.
Copy linkAny container which is to be used as a flotation device in the public waters of the state and which is subject to deterioration shall be treated externally so as to preserve the integrity of the container and prevent its deterioration. No container shall be treated in any manner which would pollute the public waters of the state.
Copy linkNotwithstanding the provisions of paragraph I, any flotation device in current use for any of the purposes described in paragraph I, on January 1, 1987, shall be exempt from this prohibition.
Copy linkAny owner who violates the provisions of this section shall be guilty of a misdemeanor.
