378:46 Cramming Prohibited. – No billing aggregator or service provider shall engage in cramming. Any billing aggregator or service provider that engages in cramming shall be subject to an administrative fine in an amount to be determined by the commission, not to exceed $1,000 per offense. The commission may consider intent as a factor when assessing administrative fines.
