Consumer guaranty contracts are not insurance and are exempt from this state's insurance laws, except for the provisions of RSA 400-A:16 through RSA 400-A:25 or as provided by this chapter.

For activities related to the marketing, selling, offering for sale, issuing, making, proposing to make, and administration of consumer guaranty contracts, an obligor or related consumer guaranty contract seller, administrator, or other related person shall be exempt from this state's insurance laws, except for the provisions of RSA 400-A:16 through 400-A:25 or as provided by this chapter.

An obligor, administrator, seller, or other related person who provides consumer guaranty contracts and insurance contracts is subject to the state's laws as they apply to the obligor, administrator, seller, or other related person for each type of agreement.
