REQUESTED ACTION

Pursuant to the provisions of RSA 14:30-a, VI, authorize the Department of Business and Economic

Affairs to transfer funds in the amount of $486,800 and create a new expenditure class code, effective

upon approval of the Fiscal Committee and the Governor and Council through June 30, 2027, and further

authorize the funds to be allocated as shown below. The original item was approved by the Fiscal

Committee on February 16, 2024 item #FIS 24-062 and approved by the Governor and Council on

February 21, 2024 item #69, and as amended by Fiscal Committee item #FIS 25-148 approved on June

20, 2025 and Governor and Council item #91 approved on June 25, 2025. 100% Federal Funds

EXPLANATION

The State of New Hampshire was allocated $122,066,151 through the American Rescue Plan Act

(ARRA), Coronavirus Capital Projects Fund (CPF), administered by the United States Department of the

Treasury, to support broadband infrastructure projects that deliver reliable, high-speed internet service to

residents and businesses across the state.

To date, the Department of Business and Economic Affairs (BEA) has received approval to accept and

expend the full $122 million in CPF funding, as follows:

• #FIS 22-247 approved on July 22, 2022 and Governor and Council item #61 approved on August

5, 2022: accept and expend $51,728,530.00 in CPF grant funds

• #FIS-22-404 approved on December 2, 2022 and Governor and Council item #38A approved on

December 7, 2022: accept and expend $65,000,000 in CPF grant funds

• #FIS-23-167 approved on May 19, 2023 and Governor and Council item #161 approved on May

31, 2023: transfer funds between existing budget classes

• #FIS 24-062 approved on February 16, 2024 and Governor and Council item #69 approved on

February 21, 2024: accept and expend $5,337,621 in CPF grant funds

• #FIS 25-148 approved on June 20, 2025 and Governor and Council item #91 approved on June

25, 2025: extend the expiration date of CPF funds until June 30, 2027

To date, the State has obligated $113.8 million to five Internet Service Providers (ISPs) to deploy

broadband infrastructure serving 51,103 previously unserved or underserved locations throughout New

Hampshire. As of September 30, 2025, ISPs have completed 46,609 broadband passings using CPF

funds.

BEA is requesting authorization to transfer funds within and among expenditure classes within accounting

unit 24410000 for the Capital Projects Fund program. Following a review of current spending patterns and

projected expenditure rates, the Department anticipates the need to realign appropriations among certain

expense classes to ensure sufficient funding for ongoing program operations. The proposed transfers

have been reviewed and confirmed to be allowable and appropriate uses of CPF funding.

This requested transfer does not Increase or decrease the Department's total authorized budget. Rather,

It allows BEA to continue administering the CPF broadband program in an efficient and fiscally

responsible manner and to ensure the timely completion of remaining project activities.

BEA Is requesting to transfer funds as shown below:

Class 022 - Rents - leases other than State - appropriation increased for rented office space

currently occupied by the Office for Broadband Initiatives.

Class 027 - Transfers to DOIT - appropriation increase for DolT support related to previously

approved positions.

Class 037 - Technology Hardware - appropriation increase for laptop and computer equipment

replacement for aged equipment related to previously approved positions.

Class 039 - Telecommunications - appropriation increase for telecom expenses associated

with previously approved positions.

Class 040 - Indirect Costs - appropriation increase to re-align the Department's indirect cost

recoveries with anticipated expenditures.

Class 041 - Audit Fund Set Aside - appropriation Increased to comply with RSA 124:16 which

requires all agencies receiving federal funds to set aside a percentage (0.1%) of federal

revenue amounts received to pay for financial and compliance audits.

Class 042 - Additional Fringe Benefits - appropriation increase for post-retirement expenses

associated with previously approved positions.

Class 059 - Temp Full Time - appropriation Increase for salaries associated with previously

approved positions.

Class 060 - Benefits - appropriation Increase for benefits associated with previously approved

positions.

Class 066 - Employee Training - appropriation increase is for training costs associated with

previously approved positions.

Class 080 - Out of State Travel Reimbursement - appropriation increase for previously

approved positions to travel to federal conferences and meetings to support the CPF program.

Class 102 - Contracts for Program Services - appropriation reduced because anticipated costs

are less than current appropriation.

BEA has two authorized programs by the ARPA CPF funds. These two programs. Broadband Contract jjH

Program and Broadband Matching Grant initiative are designed to fund local internet service providers ^

(ISPs) to provide broadband access to hard-to reach areas where investment may otherwise not be

viable. Through these CPF projects, the construction and deployment of broadband infrastructure,

designed to deliver service that reliably meets or exceeds symmetrical speeds of 100Mbps, is vital to

BEA is also aligning the programmatic distribution previously defined as $40,000,000 for the Broadband

from the United States Depntraent of the Treasury. These finds are a pM.of the. American Rescue Plan

Act of2021 (ARPA). The entire gram amount is $122,066,151, that will be available for use through

December 31.2026. Of that amourtt, $51,728,530 of these CPF fMs ««« previously accepted by BEA

when approved by the Fiscal Committee on July 22,2022 (FIS 22*247) and Governor and Council on

July27,202i(«5).

The Broadband Connect Prograni ($40,000,000) was approved by U.8. Treasury on June 7,2022. The

fimding will serve as the second round of the BCP program. Tbe program is designed to fund an approved

NH internet service piovider.GSP) to provide internet service to the most rural parts of the state lacking

fajternel service - areas wherd it vroukl not be possible without CPF (iinds.

The Broedbend Matching Grant Initiative, or BMGI, ($25,000,000) was approv^ by U.S. Treasury on

Sept 8,2022. This is the fimding mechanism crested by tte L^latuic in 2021 (Sroate Bill 85) end■mended by Senate Bill 445 in 2022. The program is draigned to provide up to a 75 percent match to

applicantB to build broadband interriet in unstrved and underserved parts of a community.

If this item is not approved, the State would need to issue layoff notices to employees hired into these

federally funded positions, created under the original request, and agencies would halt time sensitive

projects. Further, each agency would then need to submit a retroactive request to July 1,2023 for

approval to reauthorize the positions and funding; however, the retroactive requests would not

eliminate the need to issue layoff notices in June 2023.

Typically, agencies budget for known federal grants in the upcoming biennial budget; however, the

budget guidance issued in August 2022 instructed agencies to exclude all COVIO-related funding from

their FY24-FY25 budget submissions. Although the funding is authorized by the federal government

beyond June 30,2023, including this one-time funding would have erroneously inflated the FY24-

FY25 State budget.

In the event that Federal Funds are no longer available. General Funds will not be requested to support

these programs. The Department of Administrative Services seeks approval of this request

EXPLANATION

State of New Hampshire was allocated $122 million through the American Rescue Plan Act, Coronavirus

Capital Projects Fund (CPF), through the United States Treasury, for the purposes of funding broadband

infrastructure projects that deliver reliable internet service that meets or exceeds specific upload and

download speeds.

Aside from related administrative costs, the State authorized all of these funds for "last mile" broadband

infrastructure projects that provide access to highspeed broadband of at least 100 Mbps download and 20

Mbps upload speed, with the expectation of achieving 100 Mbps symmetrical, to unserved and underserved

households across New Hampshire, where feasible.

To date, the State has obligated nearly all of its CPF allocation, with BEA having sought authorization for

and approval of two rounds of the Broadband Connect Program, which resulted in authorized awards to the

New Hampshire Electric Co-op and Consolidated Communications, as well as facilitation of the Broadband

Matching Grant Initiative (BMGI) grant program, broadband mapping across the state conducted by the

University of New Hampshire, State administrative costs, and engagement of a consulting firm to support

administration, oversight, and compliance of use of CPF funds. Funds were authorized by the Fiscal

BEA now seeks to accept and expend the remaining $3,337,621 of its CPF allocations for the purposes of

continuing to fund already executed and authorized contracts and awards, such as the contracts for

broadband mapping and consulting services, as well as ongoing administrative costs and potential future

awards. For example, for the contracts with UNH for broadband mapping and Guidehouse for consulting

services, BEA.only initially requested funding for certain fiscal years, as opposed to the full duration of

those executed agreements. As previously noted, these requested funds are from within the State's existing

CPF allocation.

Funds are budgeted in the expense classes listed as follows:

Class 020 - Current Expenses -Leases - office supplies, paper and printer toner for staff.

Class 022 - Additional Rents -Leases - office space for previously approved positions.

Class 038 - Additional Technology- Software - standard software required for previously approved

positions.

Class 039 - Additional Telecommunications - phones and phone lines for previously approved positions.

Class 040 - Indirect Costs - BEA will withdraw funds at the rate of 10% of modified total direct costs; this

rate is the approved de minimus rate elected to be used pursuant to 2 CFR 200.414(f) and reported to the

Federal Government as the rate to be used for federal grants. All agencies recaving outside funding from

any source are required; by RSA 21-1:73 to recover a proportional share of the outside funding source to

alleviate agency indirect costs.

Class 041 - Audit Fund Set-Aside to comply with RSA 124:16 which requires all agencies which receive

federal funds set aside a percentage (0.1 %) of federal revenue amount received to pay for financial and

compliance audits.

EXPLANATION

Pursuant to US Treasury 31 CFR Part 35. RIN 1505-AC77, the Coronavirus State Fiscal Recovery Fund

established under the American Rescue Plan Act includes New Hampshire State funding for Broadband

Infrastructure, to ensure that all Now Hampshire citizens have access to affordable broadband, with adequate

speeds for downloading and uploading, provided to unsenred arKi underseived households and businesses. The

infrastructure must be sufficient to enable users to meet household needs of simultar^eous worit, education and

health applications and robust enough to meet increasing demand for bandwidth, as residents have a broad

range of needs which may change over time.

In order to meet federal requirements for program design, implementation and compBance, BEA will use these

funds to hire a staff of three who will be tasked with both fulfilUng the objectives of the program and the necessary

extensive reporting requirements of the grant Staff.will design and implement the tjroadband infrastructure

program through the use of contractors, state, municipal, and community partners.

As a result of the COViD-19 public health emergency, the necessity of a good internet connection to ensure

families and businesses could continue to function was highlighted, as adults tried to work from home, children to

attend classes online, individuals to obtain healthcare online and businesses move operations onfine. The

disparity of those living in low or no connectivity area was highlighted. Broadband has become critical for people

to carry out their daily lives.

REQUESTED ACTION

Pursuant to RSA l4:30-a, VI and RSA 124:15, the Department of Administrative Services (DAS) is

seeking approval on behalf of State Agencies to amend the accept and expend of American Rescue

Plan Act (ARPA) State Fiscal Recovery Funds (SFRF) requests by extending the end date for funding,

new positions, and/or new Class 046-Consultants, created in relation to the acceptance of ARPA SFRF

funds, ftom June 30,2023 to June 30,2024, effective upon approval of the Fiscal Committee and the

Govemor and Executive Council. 100% Federal Funds.

EXPLANATION

The Department of Administrative Services is seeking approval, on behalf of the State Agencies listed

in Attachment A, to extend the effective date of the attached items from June 30,2023 to June 30,

2024, This extension is allowable under the "procedural rules amendment" approved at the previous

Fiscal Committee meeting on April 21,2023. All items included in the attachment have been

previously submitted by die respective state agency responsible for the program and approved by both

the Fiscal Committee and Govemor and Executive Council. In addition, the Governor's Office of

Emerjgency Relief and Recovery (GOFERR) has reviewed the attachment and concurs with the

extensions requested.

While all ARPA SFRF must be obligated by December 31,2024, and expended by December 31,

2026, this request only serves to authorize agencies' program balances that are unspent as of June 30,

2023, as well as positions and consultants created pursuant to RSA 124:15, to cany forward into FY24

and reauthorize projects or programs that were already intended to continue utilizing authorized ARPA

SFRF into the next biennium. This will also grant agencies in coordination with GOFERR time to

further evaluate projects and programs as the ARPA SFRF obligation deadline approaches in order to

f[ ensure any funds that may need to reallocated to other uses have sufficient time to do so. Any

i; request to reallocate an existing budget or repurpose funds for nevy pc existing projects will require

I: future Fiscal Committee and Governor and Council approvals and are not contemplated in this item.

If this item Is not timely approved, the State would need to issue layoff notices to employees hired into. these federally funded positions, created under the original ARPA request, agencies would halt work

^; on time-sensitive projects or payments on existing contracts, and ongoing programs would be unable to

issue or follow through on awards. Further, each agency would then need to submit a retroactive

ti! request to July 1, 2023 for approval to reauthorize the positions and funding; however, the retroactive

p requests would not eliminate the need to issue layoff notices in June 2023.

Typically, agencies budget for known federal grants in the upcoming biennial budget; however, the

r: budget guidance issued in August 2022 instructed Agencies to exclude all COVIO-related funding

[f from their FY24-FY2S budget submissions in order to maintain the authorization methodology,compliance protocols, and audit trail that had become standard for um and oversight of ARPA SERF.

P Moreover, although the funding is authorized by the federal government beyond June 30,2023,[ j including this one-time funding would have erroneously inflated the FY24-FY2S State budget.

In the event that Federal Funds are no longer available, General Funds will not be requested to support

these programs. The Department of Administrative Services seeks approval of this request.
