Requested Action

Authorize the Community Development Finance Authority (CDFA), under the Community Development Block

Grant (CDBG) program, to award a grant to the County of Cheshire, (vendor ID#225773) 12 Court Street, Keene,

New Hampshire 03431, in the amount of $25,000, to support its planning study at the Maplewood Water

Treatment Facility located at 201 River Road, Westmoreland, NH, upon Governor and Council approval for the

period effective through June 30, 2027. 100% federal funds.

Explanation

The County of Cheshire is requesting $25,000 in CDBG funds. The funds will be used to procure an engineering

firm that will conduct a comprehensive evaluation of a county owned water treatment plant located at 201 River

Road, Westmoreland, NH. The project primarily benefits the 131 residents of Maplewood Nursing Home which is

located at the county owned property. At least 76% of the expected beneficiaries will be low to moderate income

(LMI) people.

Cheshire County's 30-year-old surface water treatment plant at the Westmoreland Complex (Maplewood Nursing

Home) is nearing end-of-life with critical components failing. The plant was engineered to produce 80,000 gallons

daily for a former correctional facility at the location; however current demand from the County nursing home is

only 14,000 gallons daily, creating fundamental system mismatch and disproportionate operational burden. The

departure of the facility's long-time licensed operator, combined with regulatory requirements for full-time staffing

and backup water supply, has created an urgent operational crisis with unsustainable costs.

Water is being provided temporarily to the nursing home by a single aging well, which cannot be the long-term

water source due to state redundancy requirements. The study will support the development of a plan to address this

issue leading to financial sustainability, operational resilience, reliable infrastructure, and preservation of affordable

long-term care access for low-income elderly populations. Total project cost for the planning activities is $26,000,

with $1,000 coming from the County of Cheshire and the remainder from CDBG.

This Agreement allocates a portion of the Community Development Block Grant (CDBG) funds provided to New

Hampshire by the U. S. Department of Housing and Urban Development (HUD). CDFA is administering this

program as provided by RSA 162-L. The funds for this contract are from the Community Development Block

Grant Fund, which is intended to help municipalities solve development problems.

CDFA has determined that the vendor is in good standing with the Secretary of State’s Office, has secured the

required levels of insurance, and has provided evidence of authority to execute and be bound by the contract.

The study will assess plant condition, capacity, and performance; analyze demand; evaluate water sources;

review treatment, storage, and distribution systems; conduct regulatory compliance audits; and provide

comparative cost-benefit analyses between treatment plant upgrades and well-based alternatives. Total

project cost for the planning activities is $26,000, with $1,000 coming from the County of Cheshire and the

remainder from CDBG.

CERTIFICATE OF COVERAGE

The New Hampshire Public Risk Management Exchange (Primex 3) is organized under the New Hampshire Revised Statutes Annotated, Chapter 5 -B,

Pooled Risk Management Programs. In accordance with those statutes, its Trust Agreement and bylaws, Primex 3 is authorized to provide pooled risk

management programs established for the benefit of political subdivisions in the State of New Hampshire.

Each member of Primex3 is entitled to the categories of coverage set forth below. In addition, Primex 3 may extend the same coverage to non-members.

However, any coverage extended to a non -member is subject to all of the terms, conditions, exclusions, amendments, rules, policies and procedures

that are applicable to the members of Primex 3, including but not limited to the final and binding resolution of all claims and coverage disputes before the

Primex3 Board of Trustees. The Additional Covered Party’s per occurrence limit shall be deemed included in the Member’s per occurren ce limit, and

therefore shall reduce the Member’s limit of liability as set forth by the Coverage Documents and Declarations. The limit sho wn may have been reduced

by claims paid on behalf of the member. General Liability coverage is limited to Coverage A (Personal Injury Liability) and Coverage B (Property

Damage Liability) only, Coverage’s C (Public Officials Errors and Omissions), D (Unfair Employment Practices), E (Employee Benefit Liability) and F

(Educator’s Legal Liability Claims-Made Coverage) are excluded from this provision of coverage.
