Requested Action
1. Authorize the Department of Transportation to enter into a contract with Stephens-Marquis Associates,
Inc. (Vendor 157584) of Merrimack, NH on the basis of a low bid of $860,079 for fuel system replacement
at Marlow Patrol Shed #403 (Project: Marlow #42850H), from the date of Governor and Council approval
through July 30, 2027, unless amended by the Department in accordance with the Standard
Specifications. 100% Other Funds.

2. Further authorize that a contingency in the amount of $43,003.95 be approved for payment of latent
conditions, which may appear during the construction of the project. The contingency requested is 5% of
the contract amount.

Explanation
This project was initiated through the Fuel Capital Fund. This project consists of constructing a new
vehicle fueling facility and removing the existing fueling facility on NH 10 at the Marlow Shed (PS403).
The scope of work at the facility will include the installation of one (1) 8,000-gallon compartmented
(4,000-gallon gasoline, 4,000-gallon diesel) underground storage tank (UST), one (1) two hose, two
product suction dispenser and concrete fueling pad with pre-manufactured pump enclosure, and all other
associated fueling system equipment and appurtenances. The project will also include the removal of one
(1) existing 3,000-gallon diesel UST, one (1) existing dispenser and associated fueling pad, and all
associated fueling system piping, equipment and appurtenances related to the existing fueling system at
this location. Engineered shoring for the tank excavation will be required.
Installation of a stormwater collection system to mitigate the impacts of impervious area added to the
site as part of the fuel replacement project consistent with the requirements of the Shorelands Act and
associated Permit by Notification is included in this project. That system includes a new roof gutter on
the sand shed and associated underground stormwater infiltration system.
The project also includes the installation of a new 40kW diesel generator.
The existing motor fuel facility shall remain fully operational until such time as the new facility is ready for
full operation with as little down time as needed for transition of the systems as possible. Up to fourteen
(14) calendar days are permitted to transfer electrical and communications equipment associated with
equipment re-use, if required.
There shall be no gap in fuel system service, availability, and operations from November 19, 2026, to
March 31, 2027.
The Contractor will be responsible to install all equipment and provide documentation in a manner which
allows the NHDOT to obtain the maximum manufacturer warranties.
The Department of Transportation is required to comply with all DES rules related to the testing and
removal of all Underground Storage Tanks (USTs). The project has been identified by Fuel Distribution
and Highway Maintenance as a priority project and location for the program to address.
The proposed contingency amount is 5% of the contract amount. This is to account for the risks
associated with any unknown conditions associated with existing or proposed facility that may include
removal and closure operations, permitting, geotechnical, groundwater or other challenges.
Although the bid costs exceeded the Department’s estimate by 2.01% the low bid of three bids received is
felt to be reasonable for the work involved. Readvertising this project would result, in our opinion, in
higher prices and prevent the completion of the work in a timely manner. The Department considers it to
be in the best interest of the State to accept this bid to accomplish these needed repairs.
The Contractor has been prequalified by this Department. The Contract has been approved by the
Attorney General as to form and execution, and the Department has certified that the necessary funds are
available and the bid reasonably conforms to the engineer’s estimate in accordance with State procedure.
Copies of the fully executed contract are on file at the Secretary of State’s Office and the Department of
Administrative Service’s Office, and subsequent to Governor and Council approval will be on file at the
Department of Transportation.
This project funding is 0% Federal funds (100% Underground Fuel Tank Replacement – Capital Fund).
A copy of the Tabulation of Bids received for this project is attached along with the Contract Supplemental
Sheet and a map indicating the location of the project.
Your approval of this resolution is respectfully requested. The Department of Transportation has
determined that the vendor is in good standing with the Secretary of State’s Office, has secured the
required levels of insurance, and has provided evidence of authority to execute and be bound by the
contract.

all other associated fueling system equipment and appurtenances. The project will also include the removal of one
(1) existing 3,000-gallon diesel UST, one (1) existing dispenser and associated fueling pad, and all associated fueling
system piping, equipment and appurtenances related to the existing fueling system at this location. Engineered
shoring for the tank excavation will be required.
Installation of a stormwater collection system to mitigate the impacts of impervious area added to the site as part
of the fuel replacement project consistent with the requirements of the Shorelands Act and associated Permit by
Notification is included in this project. That system includes a new roof gutter on the sand shed and associated
underground stormwater infiltration system.
The project also includes the installation of a new 40kW diesel generator.
The existing motor fuel facility shall remain fully operational until such time as the new facility is ready for ful l
operation with as little down time as needed for transition of the systems as possible. Up to fourteen (14) calendar
days are permitted to transfer electrical and communications equipment associated with equipment re -use, if
required.
There shall be no gap in fuel system service, availability, and operations from November 19
th, 2026, to March 31 st,
2027.
The Contractor will be responsible to install all equipment and provide documentation in a manner which allows
the NHDOT to obtain the maximum manufacturer warranties.
FEDERAL FUNDING: 0% (100% Underground Fuel Tank Replacement – Capital Fund)
CONTINGENCY: The proposed contingency amount is 5% of the contract amount. This is to account for the risks
associated with any unknown conditions associated with existing or proposed facility that may include removal and
closure operations, permitting, geotechnical, groundwater or other challenges.
PROJECT INITIATED: This project was initiated through the Fuel Capital Fund.
PROJECT EXPLANATION: The Department of Transportation is required to comply with all DES rules related to
the testing and removal of all Underground Storage Tanks (USTs). The project has been identified by Fuel
Distribution and Highway Maintenance as a priority project and location for the program to address.
TRAFFIC IMPLICATION: All construction activities will be conducted on Patrol Shed properties with no impact to
adjacent roadways.
