Requested Action

1. Authorize the Department of Transportation to enter into a contract with Neil H. Daniels, Inc. (Vendor 262804) of

Ascutney, VT on the basis of a low bid of $2,988,632 for reconstruction of NH 123A adjacent to the Cold River and Vilas

Pool Dam to repair damage resulting from a 2021 storm events, (Project: Alstead #43566A/43566B), from the date of

Governor and Council approval through November 20, 2026, unless amended by the Department in accordance with the

Standard Specifications. 100% Other Funds.

Funds are available in the following account for Fiscal Years 2026 and 2027, with the authority to adjust encumbrances

between fiscal years within the price limitation through the Budget Office, if needed and justified:

2. Further authorize that a contingency in the amount of $298,863.20 be approved for payment of latent conditions,

which may appear during the construction of the project. The contingency requested is 10% of the contract amount.

Explanation

The projects were initiated as a permanent repair response due to damage to the roadway which occurred during the

July 29-30, 2021 storm event. The projects propose a new retaining wall and 1,000 feet of roadway reconstruction along

a segment of NH 123A beginning approximately 0.1 miles north of the intersection of NH 123 and NH 123A in the Town

of Alstead. The projects reconstruct NH 123A adjacent to the Cold River and Vilas Pool Dam to repair damage resulting

from 2021 storm events, which overtopped the Vilas Pool Dam and severely eroded NH 123A.

While advertised as a single construction contract, there are two projects for Federal Emergency Management Agency

(FEMA) administration purposes. The 43566A project extends from the southerly project limits to the Vilas Pool Dam

parking area, and the 43566B project covers from there to the northerly project limits.

This section of NH 123A adjacent to the Vilas Pool Dam has a history of flood damage resulting from insufficient dam

spillway capacity during extreme storm events. The alternate spillway is NH 123A with the Cold River overwhelming

ditch lines and eroding pavement and embankments. The Department successfully applied for FEMA Project Assistance

Program mitigation funding by demonstrating a retaining wall will incorporate resilience to withstand high-flow

conditions and reduce the risk of future damage. The retaining wall stabilizes the embankment that supports NH-123A

along the Cold River east bank, thereby protecting the roadway from erosion, undermining and potential failure during

future flood events. Additional drainage, grading and rock removal adjacent to the dam, and permanent erosion control

improvements are proposed to divert away from NH 123A during flooding events. In addition to other ancillary

improvements, the roadway shoulder width and cross slope in the area of the new retaining wall has been designed to

accommodate pedestrian and bicycle traffic.

The proposed contingency amount is 10% of the contract amount. This is to account for the risks associated with the

large quantity of rock excavation and construction restrictions from project agreements such as limited roadway closure

window and maintaining access to the Vilas Pool Dam.

Although the bid costs exceeded the Department’s estimate by 20.72%, the low bid of two bids received is felt to be

reasonable for the work involved. The confines of the work site and the rural location of the project likely contributed to

the higher than expected bid prices. Major items that contributed to the increase cost include Item 203.2 - Rock

Excavation $87,000, Item 520.12 - Concrete Class A, Above Footings (F) $105,000, Item 504.101 - Common Bridge

Excavation $40,000, Item 504.2 - Rock Bridge Excavation $40,000, and Item 692. Mobilization $115,000. Readvertising

this project would result, in our opinion, in higher prices and prevent the completion of the work in a timely manner. The

Department considers it to be in the best interest of the State to accept this bid to accomplish these needed repairs.

The Contractor has been prequalified by this Department. The Contract has been approved by the Attorney General as

to form and execution, and the Department has certified that the necessary funds are available and the bid reasonably

conforms to the engineer’s estimate in accordance with State procedure. Copies of the fully executed contract are on file

at the Secretary of State’s Office and the Department of Administrative Service’s Office and subsequent to Governor and

Council approval will be on file at the Department of Transportation.

This project funding is: 90% Federal funds (FEMA Public Assistance Funds) w/ 10% Non-participating State (Betterment)

match.

A copy of the Tabulation of Bids received for this project is attached along with the Contract Supplemental Sheet and a

map indicating the location of the project.

Your approval of this resolution is respectfully requested. The Department of Transportation has determined that the

vendor is in good standing with the Secretary of State’s Office, has secured the required levels of insurance, and has

provided evidence of authority to execute and be bound by the contract.

SUPPLEMENTAL PROJECT INFORMATION SHEET

DESCRIPTION: The projects propose a new retaining wall and 1000 feet of roadway reconstruction along a

segment of NH 123A beginning approximately 0.1 miles north of the intersection of NH 123 and NH 123A in

the Town of Alstead. The projects reconstruct NH 123A adjacent to the Cold River and Vilas Pool Dam to

repair damage resulting from 2021 storm events, which overtopped the Vilas Pool Dam and severely eroded

NH 123A.

While advertised as a single construction contract, there are two projects for Federal Emergency

Management Agency (FEMA) administration purposes. The 43566A project extends from the southerly

project limits to the Vilas Pool Dam parking area, and the 43566B project covers from there to the northerly

project limits.

FEDERAL FUNDING: 90% (FEMA Public Assistance Funds) w/ 10% Non-participating State (Betterment)

match.

CONTINGENCY: The proposed contingency is 10% of the contract amount. This is to account for the risks

associated with the large quantity of rock excavation and construction restrictions from project agreements

such as limited roadway closure window and maintaining access to the Vilas Pool Dam.

PROJECT INITIATED: Permanent repair response due to damage to the roadway during the July 29-30, 2021

storm event, as noted in Description.

PROJECT EXPLANATION: This section of NH 123A adjacent to the Vilas Pool Dam has a history of flood

damage resulting from insufficient dam spillway capacity during extreme storm events. The alternate

spillway is NH 123A with the Cold River overwhelming ditch lines and eroding pavement and embankments.

The Department successfully applied for FEMA Project Assistance Program mitigation funding by

demonstrating a retaining wall will incorporate resilience to withstand high-flow conditions and reduce the

risk of future damage. The retaining wall stabilizes the embankment that supports NH-123A along the Cold

River east bank, thereby protecting the roadway from erosion, undermining and potential failure during

future flood events. Additional drainage, grading and rock removal adjacent to the dam, and permanent

erosion control improvements are proposed to divert away from NH 123A during flooding events. In

addition to other ancillary improvements, the roadway shoulder width and cross slope in the area of the new

retaining wall has been designed to accommodate pedestrian and bicycle traffic.

TRAFFIC IMPLICATION: The project includes the closure of NH 123A and a full signed detour of the project

area. The detour duration is for up to a 50-calendar day period, between the period of June 19

th, 2026

through August 14th, 2026. Detour signing will be set up prior to closure as laid out in the Plans. Notification

requirements prior to detour implementation can be found in the Proposal.

The project will use two-way alternating one-lane traffic patterns to re-open NH 123A to a single lane of

traffic facilitated by signage. This traffic pattern will also be used for short-term construction operations.

FINAL COMPLETION DATE: November 20, 2026.
