MOTION TO EXTEND TIME FOR

SUBMISSION OF MOTION FOR

RECONSIDERATION

NOW COMES Petitioner Brok-Alan Woodward-Griffith (“Petitioner,” “Griffith”), pro se, and hereby respectfully submits this motion to extend time for entry of his Motion to Reconsider Order on Petition for Access (presently without docket markings). On grounds of accident, mistake, and/or misfortune, and good faith belief, Petitioner states in support as follows.

1. On August 28th, 2025, this Honorable Court entered an order on Petitioner’s motion to access sealed court records. See Order at Doc. 138, Petition at Doc. 125.

2. On September 8th, 2025, approximately 11:50pm, Petitioner submitted his motion to reconsider via the Court’s e-File service – which generated an error message. Petitioner attempted to resubmit his filing before midnight on Monday, September 8th, 2025, in attempt to comply with the Court’s ten (10) day deadline for reconsideration. Based on discussion with the Clerk on September 9th, 2025, Petitioner learned that the timestamps had been recorded as 12:00am and 12:03am on September 9th, 2025.

3. Separately, Petitioner respectfully notes that he did not receive formal service of the Court’s order through the e-File system, but via e-mail from the Clerk, and did not become aware of

the Court’s Order until approximately August 30th, 2025 – which would have set the reconsideration deadline to September 10th, 2025.

4. Accordingly, out of abundance of caution, and due to accident, mistake, and/or misfortune, Petitioner respectfully requests that the Honorable Court consider Petitioner’s motion for reconsideration as timely. Petitioner respectfully adds that:

a. if not for the unexpected error with the e-file system, Petitioner’s motion would have been timely filed by September 8th, 2025;

b. further, being deprived of formal e-file service, and only becoming aware of the service of the Order from the Clerk via email on August 30th, 2025, this would had set the deadline for reconsideration as September 10th, 2025;

c. finally, Petitioner respectfully states it was his good faith belief that the system properly registered his filing as September 8th, 2025, and only learned the following morning of the error, and immediately took steps to remedy the situation – including by communicating with the Clerk and filing this instant motion.

5. Additionally, Petitioner respectfully states that treating the motion for reconsideration as timely, as there was only, at most, a three (3) minute filing delay past midnight on September 8th/9th, 2025, results in no prejudice to any of the parties, is a sustainable exercise of this Honorable Court’s discretion, and is in the interests of justice.

PRAYER FOR RELIEF

WHEREFORE, without prejudice and without waiving any rights, Petitioner humbly and respectfully requests that this Honorable Court:

a. Consider Petitioner’s Motion for Reconsideration Order on Petition for Access as timely filed;

b. Any such other and further relief as this Honorable Court deems just, necessary, equitable, and proper.
