In Case No. 2016-0544, State of New Hampshire v. Theo Bosa, the court on January 10, 2018, issued the following order: After review of the defendant’s motion for rehearing or reconsideration, the court modifies the slip opinion as set forth below. In all other respects, the defendant’s motion is denied.
The slip opinion dated November 30, 2017, is modified as follows: Page 4, delete the fourth sentence of the first full paragraph and replace it with the following sentence: Therefore, in order for a court, in a subsequent proceeding, to impose a sentence concurrent to a previously imposed sentence, there must be an undischarged portion of the former sentence to overlap with the latter sentence.
Reconsideration denied; slip opinion modified.
