MOTION TO EXTEND EXPERT DISCLOSURE DEADLINE

NOW COMES Eric Sweeney, by and through counsel, Lauren Prusiner, Shea Sennett, and Morgan Taggart-Hampton and respectfully requests this Court extend his deadline for disclosure of one expert report, in the above cited matter.

In support of this Motion, it is stated:

1. Eric is charged with three counts of first degree murder and falsifying physical evidence.

2. After a hearing, the Court scheduled the defense expert disclosure deadline on January 1, 2025. Defense counsel anticipates all but one expert report will be prepared and provided to the State by that date.

3. The one remaining report is that of a neuropsychologist hired by the defense. The neuropsychologist holds an out-of-state license. During the pendency of this case his temporary New Hampshire license with the Board of Psychologists expired. When he attempted to renew that temporary license he was informed that it could not be renewed, but instead he would be required to apply for full licensure in New Hampshire to continue his work. That process is long, with multiple steps, and he has been working to obtain a New Hampshire license since this issue first arose.

4. His office has now indicated that the likely timeline for approval of his New Hampshire license will be the end of January 2025. After he obtains his New Hampshire license, he needs to further meet with Eric and prepare his report.

5. Due to the delay caused by this licensing issue, the defense requires additional time for preparation of the report and to provide said report to the State. They are unable to meet the current January 1 deadline under the circumstances.

6. Eric respectfully requests that, with respect to this one report, the deadline to provide the report to the State be extended to March 1, 2025. In turn, the State's expert deadline would also likely need to be extended, and Eric would not object to such an extension.

7. Attorneys Bethany Durand and Scott Chase object to an extension of this deadline.

WHEREFORE, Eric prays the Court grant the within Motion, extending the defense deadline for expert disclosure of one report (the report of the neuropsychologist) to March 1, 2025. If not inclined to grant this Motion on its face, Eric respectfully requests that a hearing be scheduled on the matter.
